Terms and Conditions

1. Acceptance of Terms

By downloading, accessing, or using the Hang mobile application ("App") operated by Nexly Technologies ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the App. We reserve the right to update or modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to create an account and use Hang. By registering, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any time and to suspend or terminate accounts that do not meet this requirement.

3. Account Registration

To use Hang, you must create an account using a valid phone number. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

4. User Conduct

You agree to use Hang in a respectful and lawful manner. You shall not:

• Harass, threaten, intimidate, or harm any other user
• Impersonate another person or misrepresent your identity
• Use the App for any illegal or unauthorised purpose
• Post content that is hateful, discriminatory, sexually explicit, or promotes violence
• Attempt to manipulate trust scores or feedback systems
• Use automated scripts, bots, or other tools to access the App
• Solicit other users for commercial purposes, scams, or spam

5. Content Guidelines

You are solely responsible for the content you post on Hang, including profile information, photos, activity descriptions, and messages. Content must be accurate and not misleading. We reserve the right to remove any content that violates these Terms or our Community Guidelines without prior notice. By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with operating and promoting the App.

6. Safety Features

Hang provides safety features including trust scores, ID verification, SOS alerts, and live location sharing with trusted contacts. These features are provided as tools to assist you in making informed decisions about in-person meetings. However, we do not guarantee the behaviour or identity of any user. You are responsible for your own safety when meeting other users in person. We strongly recommend meeting in public places and informing a trusted contact of your plans.

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is the intellectual property of Nexly Technologies and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App or its content, nor may you reverse-engineer or attempt to extract the source code of the App.

8. Termination

We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

9. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. We do not conduct criminal background checks on users and make no representations or warranties regarding the conduct, identity, or compatibility of any user. Any interactions with other users are at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Nexly Technologies and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid us in the twelve months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
